1. Introduction
Mahzya is a marketing analytics and reporting platform that helps businesses, agencies and organisations connect marketing platforms, monitor performance, generate reports, track objectives and receive informational insights.
These Terms are between you and Axle Media (Pty) Ltd, the operator of Mahzya. If you use Mahzya on behalf of an agency, business, client or other organisation, you represent that you have authority to bind that organisation to these Terms.
2. Acceptance of the terms
By creating an account, accessing Mahzya, connecting a third-party platform or using any Mahzya feature, you agree to these Terms. If you do not agree, you must not use the platform.
3. Eligibility and authority to use the platform
You may use Mahzya only if you are legally able to enter into these Terms and have authority to connect every brand, advertising account, analytics property, social profile, website, channel or external account that you add to Mahzya.
4. Account registration and account security
You are responsible for providing accurate account information, protecting your login details and keeping access to your account secure. You must notify Mahzya if you believe your account or a connected integration has been compromised.
5. User responsibilities
You agree to use Mahzya lawfully, responsibly and only for legitimate reporting and analytics purposes.
- Keep account and brand information accurate.
- Use connected platform data only where you have permission to do so.
- Review reports and generated insights before sharing them externally.
- Comply with third-party platform terms and applicable laws.
6. Agency, client and brand account responsibilities
Agencies and users managing client brands are responsible for obtaining appropriate client authority before connecting accounts, syncing data, creating reports or sharing report links. You are responsible for managing access, disconnecting accounts when a client relationship ends and ensuring users only access data they are authorised to view.
7. Platform integrations and connected third-party services
Mahzya integrates with third-party services, including current and future analytics, social, advertising, website, SEO, reporting and custom API providers. These services are controlled by third parties and may change, restrict, delay or discontinue access without notice.
8. Meta, Facebook and Instagram integrations
Meta, Facebook and Instagram features depend on Meta permissions, account access, API availability and the pages, profiles or ad accounts you are authorised to manage. Mahzya may read eligible insights, content metadata, advertising metrics and related reporting data where permissions allow.
9. Google Analytics, Google Ads and YouTube integrations
Google Analytics, Google Ads and YouTube features depend on Google OAuth access, API permissions, account access and the properties, customers or channels available to the authenticated Google user. Google may limit, delay or change data made available through its APIs.
10. LinkedIn and other future integrations
LinkedIn and future integrations may be added, modified or removed as platform requirements and Mahzya product priorities evolve. You remain responsible for ensuring each connected service is used in line with its own developer policies and terms.
11. Access tokens, OAuth permissions and connected accounts
Mahzya uses OAuth permissions and access tokens to connect third-party services. You authorise Mahzya to use those permissions to provide the requested functionality. You may disconnect integrations, but doing so may limit reporting, syncing, objectives, notifications and generated insights.
12. Accuracy and availability of third-party data
Third-party data may be incomplete, delayed, unavailable, revised, sampled, rate limited or affected by provider outages and permission changes. Mahzya does not guarantee that third-party data is complete, current, accurate or error-free.
13. Analytics, reporting, dashboards and generated insights
Mahzya provides analytics, dashboards, reports, objectives, notifications and generated insights to help users understand marketing performance. Reports should be reviewed by the user before being shared with clients, stakeholders or the public.
14. Automated recommendations and informational limitations
Automated recommendations and AI-generated insights are informational only. They do not constitute legal, financial, accounting, tax, investment, professional or guaranteed marketing advice.
15. User-provided content, brand assets and uploaded material
You are responsible for brand assets, uploaded material, media, names, logos, report content and other information you provide to Mahzya. You represent that you have the rights needed to upload, use and process that material.
16. Ownership of user data
As between you and Mahzya, you retain ownership of your user data, brand data, uploaded materials and connected platform data, subject to the rights you grant Mahzya to provide the service.
17. Licence granted to Mahzya to process user data
You grant Mahzya a limited licence to host, store, process, analyse, display and transmit your data as necessary to operate the platform, provide reports and insights, maintain historical analytics, support users and improve service reliability.
18. Mahzya intellectual property
Mahzya, including its software, interface, workflows, reports, design, branding, documentation and underlying technology, is owned by Mahzya or its licensors. You may not copy, reverse engineer or exploit Mahzya outside the rights granted by these Terms.
19. Acceptable use restrictions
You may not misuse Mahzya, interfere with its operation, attempt unauthorised access, overload APIs, bypass security controls, scrape the platform or use it for unlawful, misleading, harmful or abusive activity.
20. Prohibited conduct
- Connecting accounts without authority.
- Using Mahzya to violate third-party platform rules.
- Uploading unlawful, infringing, deceptive or harmful material.
- Attempting to extract credentials, tokens or unauthorised data.
- Reselling access or using Mahzya to build a competing service without written permission.
21. API usage and custom integrations
API access, custom integrations or automation features may be subject to additional limits, documentation, authentication requirements and fair-use rules. Mahzya may restrict usage that threatens security, stability or third-party API compliance.
22. Subscription plans, fees and billing
Mahzya may offer free, paid, trial, agency or enterprise plans. Fees, billing cycles and included features will be described in the relevant order form, pricing page or written agreement where applicable.
23. Trials, upgrades, downgrades and cancellations
Trials, upgrades, downgrades and cancellations may affect access to features, historical data, exports, automated syncing or integrations. Unless otherwise agreed, changes take effect according to the relevant plan terms or billing arrangement.
24. Taxes
Fees may exclude taxes, duties or similar charges. You are responsible for applicable taxes unless the relevant billing arrangement states otherwise.
25. Suspension and termination
Mahzya may suspend or terminate access where there is non-payment, misuse, unlawful activity, security risk, breach of these Terms, violation of third-party platform rules or conduct that could harm Mahzya, users, clients or providers.
26. Data retention following disconnection or termination
After disconnection or termination, Mahzya may retain certain data for reporting continuity, audit, backup, security, legal or legitimate business purposes, unless deletion is required by applicable law or completed through available account deletion processes.
27. Service availability, maintenance and platform changes
Mahzya may experience downtime, maintenance, provider outages, performance issues or platform changes. We may add, modify or discontinue integrations and features at any time.
28. Beta and experimental features
Beta, preview or experimental features may be less stable, incomplete or subject to change. They are provided for evaluation and may be modified or removed without notice.
29. Third-party services and external links
Mahzya may link to or depend on third-party services. We are not responsible for third-party websites, products, policies, outages, data practices or changes to their APIs.
30. Confidentiality
Each party should protect confidential information received through the use of Mahzya and use it only for legitimate business purposes, except where disclosure is authorised or legally required.
31. Privacy and data protection
Mahzya processes personal information and connected platform data in line with its Privacy Policy. By using the platform, you acknowledge that data will be processed as described in that policy.
32. Security responsibilities
You are responsible for maintaining secure devices, accounts, passwords, authorised users and connected platform access. Mahzya is responsible for applying reasonable safeguards to the platform itself.
33. Disclaimers
Mahzya is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We disclaim warranties that the platform will be uninterrupted, error-free, secure, complete or fit for a particular outcome.
34. No guarantee of marketing, advertising or business results
Mahzya does not guarantee campaign performance, audience growth, search rankings, leads, sales, revenue, conversions, return on ad spend or other business results.
35. Limitation of liability
To the maximum extent permitted by law, Mahzya will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of revenue, loss of data or business interruption arising from use of the platform.
36. Indemnification
You agree to indemnify Mahzya against claims, damages, losses and expenses arising from your misuse of the platform, breach of these Terms, unlawful conduct, unauthorised account connections or violation of third-party rights.
37. Force majeure
Mahzya is not responsible for delays or failures caused by events beyond reasonable control, including outages, cyber incidents, provider failures, labour disputes, natural events, legal restrictions or infrastructure disruption.
38. Governing law and jurisdiction
These Terms are governed by the laws of [GOVERNING JURISDICTION]. Courts or forums in that jurisdiction will have authority unless applicable law requires otherwise.
39. Dispute resolution
Before starting formal proceedings, the parties should attempt to resolve disputes in good faith through written notice and reasonable discussion, unless urgent legal relief is required.
40. Changes to the terms
Mahzya may update these Terms from time to time. Material changes may be notified through the platform, email or another appropriate method. Continued use after changes take effect means you accept the updated Terms.
41. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect and the unenforceable provision will be interpreted as closely as possible to its original purpose.
42. Entire agreement
These Terms, together with any applicable order form, plan terms, privacy policy or written agreement, form the entire agreement between you and Mahzya regarding use of the platform.
